Terms of use of the KM Builder:

1. Scope of Services: KM Builder will provide construction services as agreed upon with the client. This may include, but is not limited to, design, project management, construction, and related services.

2. Payment: The client will pay KM Builder for the services rendered as outlined in the contract. Payment terms and conditions will be agreed upon in writing prior to the start of any work.

3. Change Orders: The client may request changes to the scope of work, schedule, or budget, which will be considered as a change order. Any changes to the scope of work or budget must be approved in writing by both parties prior to implementation.

4. Termination: Either party may terminate the contract at any time with written notice. In the event of termination, the client will pay KM Builder for any services provided up to the termination date.

5. Warranties and Guarantees: KM Builder warrants that all services will be performed in a professional and workmanlike manner in accordance with industry standards. KM Builder does not provide any guarantee or warranty beyond what is specifically outlined in the contract.

6. Liability and Indemnification: KM Builder is not liable for any damages, losses, or expenses incurred by the client or any third party as a result of the construction services provided, unless such damages are caused by KM Builder’s negligence or willful misconduct. The client will indemnify and hold KM Builder harmless from any claims, damages, or expenses arising from the client’s breach of the contract or any applicable laws or regulations.

7. Confidentiality: KM Builder agrees to keep all client information confidential and not disclose any such information to third parties, except as required by law or with the client’s written consent.

8. Intellectual Property: All intellectual property rights related to the construction services provided by KM Builder shall remain the property of KM Builder, unless otherwise agreed upon in writing by both parties.

9. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the jurisdiction where KM Builder is located, without giving effect to any choice of law or conflict of law provisions.

10. Entire Agreement: This agreement constitutes the entire understanding between KM Builder and the client and supersedes all prior agreements or understandings, whether written or oral.

By accepting the terms and conditions, the client agrees to be bound by the terms of this agreement. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
